If you are injured in a motor vehicle accident while working you may choose between workers’ compensation benefits or using the medical provisions of your Personal Injury Protection Coverage on your auto insurance. A recent decision in the Appellate Court allows you to make the choice and requires your employer to repay your PIP carrier for the treatment. A word of caution: your employer will not be required to pay for lost time when the doctor you choose puts you out of work.                                     

In the event of an injury at work, your employer directs medical treatment. If that treatment ends and you are back to work you can continue to receive treatment for your pain through the PIP carrier and choose the doctor you want to treat you. In a motor vehicle injury at work this will allow you to be treated without being controlled by the workers compensation carrier.
