         <title>Attorney Michael A. Brusca Authored Article in US1</title>
         <description><![CDATA[<p>Stark &amp; Stark attorney <a href="http://injury.stark-stark.com/lawyer-attorney-1525576.html">Michael A. Brusca</a> in the firm&rsquo;s <a href="http://injury.stark-stark.com/lawyer-attorney-1495634.html">Nursing Home Litigation Group</a> authored the article &ldquo;<em>Pressure Ulcers- Catastrophic Negligence</em>,&rdquo; published in <span style="text-decoration: underline;">US1</span>&nbsp;on May 15, 2013.&nbsp; The article discusses pressure ulcers, or bed sores, which many patients of nursing homes, asssisted living facilities, hospitals, group homes and rehab facilities develop.</p>
<p>Mr. Brusca how pressure ulcers are developed, as well as what needs to be done to prevent them, as they can be lethal if left untreated.</p>
<p>Mr. Brusca explains, "Pressure ulcers are evidence of neglect. &nbsp;In fact, Medicare will not may for pressure wounds a patient develops in the hospital if the wound goes past Stage III- Medicare believes these should never happen absent neglect." &nbsp;One of the issues many care facilities face is minimum staffing levels. &nbsp;"Unfortunately, in these scenerios there is insufficient staff to make sure residents are appropriately repositioned and kept clean and dry. &nbsp;The terrible outcome is pressure ulcers."</p>

         <title>Attorney Michael A. Brusca Authored Article in New Jersey Law Journal</title>
         <description><![CDATA[<p>Stark &amp; Stark attorney <a href="http://injury.stark-stark.com/lawyer-attorney-1525576.html">Michael A. Brusca</a> in the firm&rsquo;s <a href="http://injury.stark-stark.com/lawyer-attorney-1495634.html">Nursing Home Litigation Group</a> authored the article &ldquo;<em>Assisted Living Facility Litigation: An Overview</em>,&rdquo; published in the<span style="text-decoration: underline;"> New Jersey Law Journal</span> on May 6, 2013.&nbsp; The article discusses how and why assisted living facility (&ldquo;ALF&rdquo;) litigation is on the rise.</p>
<p>Mr. Brusca explains that ALFs have become profitable for investors, which creates natural tension &ldquo;especially when profit may be increased by decreasing staff levels and competence.&rdquo;&nbsp; There is a lack of a uniform and specific regulatory structure amongst ALFs, which could potentially lead to a significant variation in levels of care and service.&nbsp;</p>
<p>Mr. Brucsa states, &ldquo;ALF litigation is on the rise, and there is no inclination that this trend is likely to reverse.&nbsp; However, understanding how to properly handle these complex claims is important to protecting your client&rsquo;s rights.&rdquo;</p>

         <title>Shareholder Carin O&apos;Donnell to Present Pennsylvania Bar Institute Seminar</title>
         <description><![CDATA[<p>Stark &amp; Stark Shareholder <a href="http://injury.stark-stark.com/lawyer-attorney-1525506.html">Carin O&rsquo;Donnell</a> will be presenting at the seminar &ldquo;How to Conduct am Effective Direct and Cross Examination,&rdquo; through the Pennsylvania Bar Institute.&nbsp; The seminar will be held at the PBI Conference Center in Mechanicsburg, PA on Tuesday April 23, 2013 at 9:00am, and at the CLE Conference Center in Philadelphia, PA on Tuesday, April 30, 2013 at 9:00am.&nbsp; Attendees can earn up to three substantive CLE credits and one ethics CLE credit.</p>

         <title>Stark &amp; Stark Shareholder Wins $1.5M Settlement for Client Suffering from Mild Traumatic Brain Injury</title>
         <description><![CDATA[<p>Stark &amp; Stark Shareholder <a href="http://injury.stark-stark.com/lawyer-attorney-1523028.html">Bruce H. Stern</a> was featured in the March 11, 2013 edition of the <span style="text-decoration: underline;">New Jersey Law Journal</span> section of &ldquo;Suits &amp; Deals&rdquo; for his recent victorious settlement of $1.15M.&nbsp; His client, Edward Condiracci, slipped, fell and hit his head on snow covered ice, leading to mild brain trauma.&nbsp; Side effects from the injury, which included diminishing his concentration ability, prevented Mr. Condiracci from being able to return to work.&nbsp; He was an employee and 10 percent owner of Electronics Design Group, but was forced to sell his shares in the company and retire.&nbsp; The two defendants, Jeremy Halpern, the homeowner, and JW Custom Homes LLC of Newfoundland, the construction company at the home, were both held equally responsible for the injury. &nbsp;</p>

         <title>Stark &amp; Stark Shareholder Bruce Stern Blogs About Recent Verdict in Favor of Client</title>
         <description><![CDATA[<p>A Burlington County jury recently returned a verdict in favor of Stark &amp; Stark Shareholder Bruce Stern&rsquo;s client.&nbsp; The verdict found that the Florence Township Board of Education and its school bus driver were partially responsible for an incident that occurred in 2009 in Florence Township, New Jersey.&nbsp; Stern&rsquo;s client was stopped on a street corner while on his bicycle when the bus driver drove the right rear tire of her school bus over his left foot when making a turn. &nbsp;<br /><br />While the Florence Township Police investigating police officers determined that Mr. Singh had lost control of his bicycle on the sidewalk and rolled into the street at the time of the accident, Mr. Stern retained an accident reconstruction expert as well as an orthopedic surgeon who, based on science and medicine, were able to determine that his client was at a complete stop, straddling his bike with his left foot in the crosswalk.&nbsp; With this new evidence, Mr. Stern argued that the defendant school bus driver was negligent in failing to make observations as she turned her vehicle. &nbsp;<br /><br />The jury agreed that the plaintiff and the defendant school bus driver were both equally at fault, and the plaintiff was entitled to recover half of his damages. &nbsp;<br /><br />To read the full article, please click <a href="http://www.braininjurylawblog.com/personal-injury-claims-florence-township-bus-driver-held-partially-responsible-for-incident.html">here</a>.</p>]]></description>

         <title>Stark Shareholder Featured in Article for His Involvement with Community Fundraiser</title>
         <description><![CDATA[<p><a href="http://injury.stark-stark.com/lawyer-attorney-1525541.html">Tyler Tomlinson</a>, Shareholder in Stark &amp; Stark&rsquo;s <a href="http://injury.stark-stark.com/">Accident &amp; Personal Injury Group</a>, was featured in the article <em>Volunteer turn out, Byers&rsquo; Choice Kicks in $25k to help save Kids Castle</em> in <span style="text-decoration: underline;">The Reporter </span>on January 6, 2013.  The article discusses the community movement to save Kids Castle, a large and incredible playground in Doylestown, PA which is in need of being restored and maintained.   Tomlinson is the Save Kids Castle community liaison who helped coordinate this fundraiser.</p>
<p>Over 100 volunteers, families and children attended an event on December 8th, which helped spread the word about the fundraising challenge.  Since then, over $50,000 has been raised, helped largely by a $25,000 matched donation by Byers&rsquo; Choice Ltd.</p>
<p>Mr. Tomlinson said, &ldquo;It is heartwarming to see the community come together to revitalize such a magical place for our children.&rdquo;  He went on to explain, &ldquo;Because of the efforts of the community, and the generosity of Byers&rsquo; Choice, we only need to raise an additional $100,000 by March 31 in order to fully renovate and restore the iconic castle with new play features.&rdquo;</p>

         <title>Stark Shareholder Featured in Article for his Award for Service from the Mercer County Bar Association</title>
         <description><![CDATA[<p><a href="http://injury.stark-stark.com/lawyer-attorney-1522995.html">Albert M. Stark</a>, Shareholder in Stark &amp; Stark&rsquo;s <a href="http://injury.stark-stark.com/">Accident &amp; Personal Injury Group</a>, was featured in The Trentonian newspaper for his recent honor of being presented with the prestigious Michael J. Nizolek Award for Service by the Mercer County Bar Association at its annual Foundation Dinner Dance last month.&nbsp;</p>
<p>The award, which honors and recognizes an individual for unselfish contributions to both the legal profession and community, was created in 1995 in memory of Michael J. Nizolek who served as a past-president of the Mercer County Bar Association.</p>
<p>The article states that Mr. Stark &ldquo;has pioneered the use of video and demonstrative evidence in the courtroom, and his victories have led to safer cars, bicycles, recreational vehicles, industrial equipment and roads. He has received awards recognizing his expertise, advocating for people with brain, spinal cord and burn injuries.&rdquo;&nbsp;</p>

The article discusses the fact that when someone is injured at work, their privacy, in relation to their medical history and personal life, is often times invaded by insurance companies looking for evidence that can be used to deny their workers&rsquo; compensation claim.</p>
<p>Mr. Kravitz states, &ldquo;What we&rsquo;re seeing now are requests to rifle through records going back 10 or 20 years that often have no relevance to the claim. The second major privacy issue with workers&rsquo; compensation is the increasing use of social networks to investigate claimants.          <title>Separate Insurance Limits Covering the Independent Claim of Emotional Distress from Watching a Loved One Suffer or Die</title>
         <description><![CDATA[<p>New Jersey law permits a person to file an independent claim for emotional distress resulting from the shock of watching a loved one at the scene of an accident suffer or die, or from seeing efforts to revive her/him being unsuccessful. <span style="text-decoration: underline;">Portee v. Jaffee</span>, 84 N.J. 88 (1980). <br /><br />If the incident from which the emotional distress claim arose is due to a car accident, the &ldquo;per injury&rdquo; liability limits of the at-fault driver&rsquo;s auto insurance policy will apply to provide coverage for said claim. <span style="text-decoration: underline;">Wolfe v. State Farm Ins. Co</span>., 224 N.J.          <title>By Choosing the &quot;Verbal&quot; Threshold, You Have Limited Your Own Right to Sue As Well As Your Immediate Family Members&apos; Rights</title>
         <description><![CDATA[<p>When you select the &ldquo;limitation on lawsuit&rdquo; or &ldquo;verbal&rdquo; threshold on your <a href="http://injury.stark-stark.com/lawyer-attorney-1507127.html">auto insurance coverage</a>, you have essentially limited your right to sue for non-economic losses arising from an <a href="http://injury.stark-stark.com/lawyer-attorney-1495636.html">auto accident</a>, unless you suffer at least one of six types of injuries:</p>
<ol>
<li>Death</li>
<li>Dismemberment</li>
<li>significant disfigurement or scarring</li>
<li>a displaced fracture</li>
<li>loss of a fetus</li>
<li>a permanent injury</li>
</ol>
<p><br />Thus, even if you suffer a significant permanent soft-tissue injury to your spine or joints, your case may still get dismissed. One way to overcome the threshold is to show, through expert testimony, extensive and consistent treatment through the day of trial.<br /><br />When you choose the &ldquo;Verbal Threshold&rdquo; you have not only limited your right to sue, but you have also limited the right of your spouse and/or children to maintain a lawsuit as well. Fortunately, your election to limit your right to sue will not apply to your parents and/or grandchildren who live with you. Nor will your election apply to listed drivers who are not immediate family members.<br /><br />Rather than limit your rights and those of your resident family members, elect the &ldquo;no limitation on lawsuit&rdquo; or &ldquo;zero&rdquo; threshold on your auto insurance coverage.&nbsp; The &ldquo;zero&rdquo; threshold permits you to sue for non-economic damages without limitation.</p>

         <title>A Diverse Bar to Better Serve a Diverse Community</title>
         <description><![CDATA[<p>I am a co-chairperson of the New Jersey Association for Justice&rsquo;s Minority Concerns Committee.&nbsp; NJAJ is a 2,000 attorney strong organization dedicated to serving New Jersey&rsquo;s families by working to preserve and strengthen the laws that protect them.&nbsp; As a chairperson of the Minority Concerns Committee, I implemented the Outreach Program which is designed to increase NJAJ&rsquo;s diversity membership and leadership.<br /><br />As a co-chairperson of the Outreach Program, I recently held a summit meeting and invited delegates from all of New Jersey&rsquo;s minority/specialty bar associations.&nbsp; The meeting covered issues such as determining the minority/specialty bar associations&rsquo; membership needs, discussion of joint educational programs and finding minority/female talent to serve as NJAJ leaders and educational speakers. As a result of these efforts, NJAJ now offers a discount to members of these minority/specialty bar associations for certain educational seminars.&nbsp; Further, NJAJ is about to launch a &ldquo;listserve&rdquo; (an on-line real-time instant message platform) made up of delegates from NJAJ and these minority/specialty bar associations.&nbsp; In this way, open lines of communication are maintained and greater cooperation can be achieved between the organizations. &nbsp;<br /><br />I strive to increase NJAJ&rsquo;s diversity membership and leadership through the Outreach Program so that New Jersey&rsquo;s attorneys can provide better representation and protection to New Jersey&rsquo;s diverse families. &nbsp;</p>

         <title>Volunteer Firefighters: No coverage under the fire department&apos;s auto insurance policy for using a vehicle not owned by the fire department</title>
         <description><![CDATA[<p>Volunteer fire fighters who utilize a vehicle that is not owned by the fire department to respond to an emergency call are not covered under the fire department&rsquo;s insurance coverage unless the policy specifically states that it provides coverage for volunteer employees who use &ldquo;commandeered&rdquo; or their own personal vehicles.<br /><br />Thus, unwittingly, volunteer fire fighters who utilize their own personal vehicles in response to emergency calls will likely be subject to the limited coverage of their own personal auto insurance coverage.&nbsp; This may result in limited insurance protection in case of catastrophic injuries during a motor vehicle accident.<br /><br />If you are a volunteer fire fighter, be sure to obtain the highest possible limits of auto insurance coverage to protect yourself in case the fire department&rsquo;s insurance policy does not provide coverage when you are utilizing a &ldquo;commandeered&rdquo; or your own personal vehicle.&nbsp; Alternatively, if an accident has already occurred, retain an attorney immediately to review the fire department&rsquo;s insurance policy to determine whether insurance coverage may be had.</p>]]></description>

         <description><![CDATA[<p><a href="http://injury.stark-stark.com/lawyer-attorney-1522645.html">Denise Mariani</a>, of Stark &amp; Stark&rsquo;s <a href="http://injury.stark-stark.com/">Personal Injury Group</a>, recently obtained a $250,000 jury verdict for Rosetta Martin of Trenton, New Jersey. Ms. Martin, a security guard at Home Depot, sued International Motor Freight of Newark after she was seriously injured in 2007 when a disgruntled IMF employee slammed his truck door on her right arm at the Home Depot Distribution Center in Cranbury, New Jersey.</p>
<p><a href="http://www.trentonian.com/articles/2011/11/02/news/doc4eb135e872786360342854.txt">An article in today&rsquo;s Trentonian</a> states, &ldquo;After the jury found in favor of the plaintiff on Monday, Martin&rsquo;s lawyer, Denise Mariani of the Lawrenceville-based law firm of Stark and Stark, issued a statement calling the verdict &lsquo;fair in light of the serious injury&rsquo; Martin suffered. Mariani said the defense &lsquo;tried to call (Martin) a liar, but the jury determined it was really the defense that was loose with the truth.&rsquo; The jury awarded Martin $200,000 for pain and suffering, $35,000 for medical expenses, and $15,000 for lost wages, said attorney J. Robert Bratman.&rdquo;</p>]]></description>

         <title>How to Prove That a Dog has Dangerous Behaviors Even Though it has Never Bitten Anyone Before  </title>
         <description><![CDATA[<p>In New Jersey, the owner of a dog that bites someone is directly responsible for the injuries it causes. Additionally in New Jersey, a person that does not own the dog, but merely harbors it on its property (such as a landlord or animal shelter), could also be liable when it knew of the dog's possible dangerous behavior. Proof of dangerous behavior includes that the dog had jumped for, growled at or showed it's teeth to strangers. Therefore, a prior bite is not necessary in order for the courts to find that a dog has "dangerous behaviors."</p>
<p>In addition, the following may also constitute evidence of a dog's dangerous behavior: the dog is being confined away from other animals and people; the dog is undergoing rehabilitation with a trainer who is experience and skilled in handling aggressive dogs; and the dog exhibits fearful behavior. In the appropriate case, a canine behavior expert may be retained to investigate the evidence and assess the dog's behavior. The canine expert may testify whether a god is aggressive, as well as whether "fearful" dogs can turn aggressive towards strangers. This expert testimony may also constitute additional and compelling evidence of the dog's dangerous behavior.</p>
<p>In conclusion, even though a dog has never bitten anyone before, a viable claim may still be lodged against a person who does not own the dog but merely keeps it on it's property if there exists other evidence of the dog's aggressive behavior.</p>

         <title>Using A Cell Phone While Driving is Not Only Dangerous, But Also Illegal  </title>
         <description><![CDATA[<p>On my way to work each day, I have to wait at a busy intersection to make a left hand turn. Often, while I am waiting at the light, I see drivers traveling by while holding a cell phone to their ear. I think we all have seen instances where drivers are distracted while speaking on a cell phone and yet drivers continue to ignore the law. The statute in New Jersey which allows a police officer to charge a motorist with the improper use of a cell phone while driving, is listed at N.J.S.A. 39:4-97.3. There has not been a flurry of opinions from our courts interpreting this statute, however, in an unpublished opinion titled <span style="text-decoration: underline;">State v. Malone</span>, decided on July 1, 2011, our Appellate Division recently reversed a driver&rsquo;s conviction for an alleged cell phone violation.</p>
<p>In <span style="text-decoration: underline;">Malone</span>, our Appellate Division ruled that N.J.S.A. 39:4-97.3 does not limit the use of a hands-free telephone to listening because a motorist using a hands-free wireless telephone is also permitted to hold the wireless telephone in one hand while activating, deactivating or initiating a function of the telephone. The Appellate Court concluded that initiating a function of the hands-free wireless telephone includes driving; and it may be necessary to press more than one button to &ldquo;activate, deactivate, or initiate a function of the telephone.&rdquo;</p>
<p>The Appellate Court emphasized, other than in an emergency, a motorist may only engage in a conversation on a cell phone if the telephone is equipped with a hands-free device. The motorist may not hold the telephone in one hand while talking to, or listening to,  the person on the other end of the phone. A motorist is also prohibited from holding the telephone to send a text message or electronic mail. The only circumstance in which a motorist is permitted to hold a wireless cell phone in one hand, with the other hand on the steering wheel, is when the motorist is activating, deactivating or initiating a function of the telephone, which includes answering the phone, ending the phone call or dialing a phone number.</p>
<p>Our Appellate Court pointed out that seven other states and the District of Columbia have enacted statutes that impose limits on the holding of a cell phone  while driving. See Cal. Veh. Code Section 23123 (2011); Conn. Gen. Stat. Section 14-296aa (2011); Del. Code Ann. tit. 21, Section 4176c (2011); D.C. Code Section 50-1731.04; Md. Code Ann., Transp. Section 21-1124.2 (2011); N.J.S.A. 39:4-97.3; N.Y. Veh. &amp; Traf. Law, Section 1225c (McKinney 2011); Or. Rev. Stat. Section 811.507 (2011); Wash. Rev. Code Section 46.61.667 (2010).</p>
<p>I believe in the near future additional states will enact laws to impose limits on the holding of a cell phone while driving. It shouldn&rsquo;t take more accidents caused by distracted drivers holding cell phones to get legislators around the country to pay attention to this serious traffic safety issue.</p>]]></description>
